Amnesty for illegal residents and workers in North Cyprus is out officially
The "Immigration Amnesty", officially known as the "Foreigners Immigration (Amendment) Bill", approved by the TRNC Parliament by a majority of votes last week has been officially approved.
In an announcement made by the TRNC Ministry of Internal Affairs on Wednesday, November, 3,2021, it was stated that the Immigration Amnesty had begun. The statement also included who can benefit from the amnesty and how.
The amnesty was introduced due to the inability of the economy to grow due to the economic crisis in the country, the deterioration of family integrity, the inability to prevent illegal workforce, the closure of administrative institutions and workplaces due to problems caused by the Covid19 epidemic in the country which caused disruptions in permit procedures. The Law on Foreigners and Immigration (Amendment) was introduced to overcome these problems.
“Students, workers and residence permit holders who have been sentenced for several reasons in the TRNC without permission, can benefit from the amnesty which will remain in force for 90 days from the date it was published in the Official Gazette on November 3, 2021 until January 31, 2022.
I- WHO CAN BENEFIT?
As of the effective date of the law;
- Persons who did not leave the country even though the Residence, Work, Business and Student Permit given to them upon entry to the Turkish Republic of Northern Cyprus has expired,
- Persons who entered with a Tourist Visa and did not leave the country after 1 January 2020,
- Persons who have been dismissed due to Unauthorized Residence and Work ,
- Spouses, unmarried children under the age of 25, children with disabilities over the age of 18, of the beneficiaries of the current Amnesty,
- Persons who could not complete their transactions after paying their fees in the 39/2019 Work Amnesty,
- 39/2019 Spouses, single children under the age of 25, children with disabilities over the age of 18,
- Persons who are abroad and whose Work Permit, Residence Permit, Business Establishment Permit expires in the TRNC and who exit the country with penalty and are blocked from entering the country,
- University Students who are abroad and have been suspended,
- Persons who are married to a TRNC Citizen who are abroad and have been penalized,
- Spouses of Persons with Residence Permit, Students, Work, Business and Establishment Permits who are abroad and have been penalized,
- Single children under the age of 25, children with disabilities over the age of 18 of Persons with Residence Permit, Students, Work, Business and Establishment Permits who are abroad and have been penalized.
- Persons who are abroad and sentenced on a Tourist Visa after January 1, 2020,
- Foreign nationals who have been expelled from the Turkish Republic of Northern Cyprus due to work or residence without a work permit and who are abroad will be able to benefit from amnesty if they fulfill the conditions specified in the Law.
II- HOW CAN I BENEFIT FROM IT?
A- PEOPLE IN THE TURKISH REPUBLIC OF NORTHERN CYPRUS: To be able to benefit from the amnesty, visit the official website of the immigration department, https://permissions.gov.ct.tr/amnesty2021/log within 90 days from the date of entry into force and pay the minimum fee online.
- Persons who did not leave the country even though their Residence, Work, Doing Business, Business and student Permit given to them upon entry to the Turkish Republic of Northern Cyprus has expired; can pay the minimum wage within 10 days from the date of Approval of the Immigration Office after making an online application,
- Persons who enter with a Tourist Visa and do not leave the country even though it has expired; Provided that you pay a minimum wage within 10 days from the date of the Immigration Office Approval after submitting an online application, (those whose tourist visa expires before 1 January 2020 cannot benefit from this right).
- Persons who have been dismissed due to Unauthorized Residence and Work; Provided that you pay a minimum wage within 10 days from the date of the Immigration Office Approval after submitting an online application, (those whose tourist visa expires before 1 January 2020 cannot benefit from this right).
- Spouses, single children under the age of 25, children with disabilities over the age of 18; Spouses of sentenced persons apply to the Immigration Office within 60 days after the amnesty is granted, (They will be exempted from paying the penalty)
- Persons who cannot complete their transactions after paying their fees in the 39/2019 Work Amnesty; can complete their procedures by applying to the Labor Office with the document proving that they have paid the 2019 Labor Amnesty fee. (They will be exempted from paying fines).
- 39/2019 Spouses, single children under the age of 25, children with disabilities over the age of 18, of persons who have completed the necessary procedures in the Work Amnesty and have not been able to pay their fees; Application to the Immigration Office with the document proving the family ties with the person who has completed the necessary procedures in the 2019 Work Amnesty (They will be exempted from paying the penalty).
B- THOSE WHO HAVE BEEN ABROAD
They will be able to benefit from immigration amnesty by entering the Turkish Republic of Northern Cyprus within 90 days from the date of entry into force of the law and paying a fine amounting to a minimum wage (4,970 TL) in effect when entering .
- Persons who are abroad and whose Work Permit, Residence Permit, Doing Business, Establishment Permit expires in the TRNC and who exit the country with a penalty and are blocked from entering the country; By paying a minimum wage when entering the country, provided that the employer makes a preliminary permit application to the Labor Office before the person arrives,
- University Students who are abroad and have been suspended; By paying a minimum wage on the condition that they have a student admission document on their entry into the country and a student certificate for those who take a break,
- Persons who are married to a TRNC Citizen who are abroad and have been penalized; by paying a minimum wage and a document proving that they are married when they enter the country,
- Spouses of Persons with Residence Permit, Students, Work, Business and Establishment Permits who are abroad and have been penalized; by paying a minimum wage and a document proving that they are married when they enter the country,
- Single children under the age of 25 of Persons with Residence Permit, Students, Work, Business and Establishment Permits who are abroad and have been penalized, children with disabilities over the age of 18; by paying a minimum wage and a document proving that they are disabled and that they are a child of the person when they enter the country,
- Persons who are abroad and sentenced with a Tourist Visa; By paying a minimum wage when entering the country, provided that the employer makes a preliminary permit application to the Labor Office before the person arrives, (Those whose tourist visa expires before 1 January 2020 and who go abroad cannot benefit from this right).
- Foreign nationals who have been expelled from the Turkish Republic of Northern Cyprus due to work or residence without a work permit and who are abroad; After making an application to the TRNC consulates or representative offices abroad, criminal record or criminal record, preliminary permit requirement and the necessary examination and approval by the Immigration Department, by paying a minimum fee when they enter the country,
