Man sentenced to 3 and a half years in prison for rape of minor

A Turkish man who was accused of raping an under age girl in Lefkosa has been sentenced to 3 years and 6 months in prison.

The defendant identified as Burak Mutlu Atılgan committed the crime on December, 26, 2021 in Lefkosa and taken to court on charges of raping a 13-year-old girl. 

Police said the defendant took the 13-year-old victim into the forested area of ​​Osman Örek street on the grounds that they were going to shop with the vehicle that the suspect had in his use. He was arrested on the same date, his vehicle was taken as evidence.

The Judgement:

Court Judge announced the unanimous decision of the Lefkosia Heavy Penal Court committee on Thursday, November, 2022. 

The Judge stated that the crime of “Sexual Rape of a Child Under the Age of 16” is one of the very serious crimes that impose a life sentence. He noted that in crimes against minors, consent is not sought regardless of the type of crime committed, and underlined that the increase in crimes against children causes concern in the society.

He noted that when the facts were examined, the expert stated in his report that the complainant was open to guidance. He mentioned that the experiences of the child could negatively affect her whole life, and underlined that it is not possible to look at such crimes with tolerance.

The judge stated that they evaluated the serious age difference between the complainant and the accused against him on the date of the incident. 

Touching upon all the issues in favor and against the accused, the judge announced that they unanimously sentenced him to 3 years and 6 months in prison.
